Here’s the 4-1-1 on LB411

The new law, signed by Governor Pete Ricketts on May 24, 2021, promotes participation in the statewide designated health information exchange, which is CyncHealth. Electronic health information exchange allows providers and patients to appropriately access and securely share a patient’s vital medical information electronically—improving the speed, quality, safety, and cost of patient care.

Under LB411, participation means the sharing of clinical data through electronic health records. CyncHealth standards for data completeness follow the USCDI, promoting interoperability and public health reportable information. It is not the function of LB411 to require facilities to report new data outside of USCDI and regulatory standards.

Healthcare facilities required to participate include ambulatory surgical centers, critical access hospitals, general acute hospitals, health clinics, hospitals, intermediate care facilities, long term care hospitals, mental health and substance use treatment centers, PACE (Program of All-Inclusive Care for the Elderly) Centers, pharmacies, psychiatric or mental hospitals, public health clinics, rehabilitation hospitals, diagnostic, laboratory, and imaging centers.

Payers participating include insurers, health maintenance organizations, Medicare or Medicaid, a legal entity which is self-insured and provides health care benefits for its employees, or a person who is responsible for administering the payment of healthcare expenses for another person or entity.

LB411 excludes long-term care facilities, assisted living homes, skilled nursing facilities and any state-run healthcare facility (BSDC, regional centers, youth treatment facilities) from participation.

Connection costs are dependent on your EHR. CyncHealth will work with you and your EHR vendor to properly scope out the project so your EHR vendor can provide accurate pricing prior to starting the project to connect.

CyncHealth utilizes a subscription-based pricing structure for participation. For pricing specific to your facility, please contact our Account Management team via email: AccountManagement@CyncHealth.org.

September 30, 2021 is the deadline for when facilities must participate under the terms of LB411. To be eligible for funding of connection costs a facility must identify to CyncHealth by July 1, 2021.

There is the option of applying for a waiver of participation, which will be available soon. Please check back—we will post as soon as the form is available.

No action is required; it is business as usual for you. There are no changes to what you enter into your EHR or submit to CyncHealth. Thank you for being part of CyncHealth!
